  • § 3-36. Identifikation mellem forsikrede og dennes hjælpere

    Assurandøren kan ikke overfor forsikrede påberåbe sig fejl eller forsømmelser begået af fartøjets fører eller mandskab i tjeneste som søfarende.

    Assurandøren kan overfor forsikrede påberåbe sig fejl eller forsømmelser begået af alle organisationer eller personer, der har fået delegeret beslutningstagende myndighed fra forsikrede vedrørende funktioner af væsentlig betydning for forsikringsdækningen, såfremt fejlen eller forsømmelsen knytter sig til en sådan funktion.
